A Daviess County-based animal rescue group has filed suit against Daviess Fiscal Court over a rule requiring rescue groups to return dogs they adopt from the county animal shelter, if a dog’s original owner comes forward to claim the animal within a 30-day period. The rescue group is asking the judge to declare the rule improper and unenforceable. According to the suit filed by Saving Paws Animal Rescue of Kentucky’s president John Austin, the memorandum of agreement was created by county Judge-Executive Al Mattingly Jr. “without following any statutorily mandated procedure for making such a rule.” Normally, an animal who has been at the shelter 5 days becomes County property.
