Who gets to light up the proposed 205-acre Gateway Commons mega retail office residential development between 54 and Pleasant Valley Rd.? That’s the question in a lawsuit filed by Kenergy against OMU. Kenergy claims the company is entitled to provide power in the part of Gateway Commons that falls within what the company calls its “exclusive service territory,” and that OMU is attempting to “selectively encroach” on that territory. But OMU claims in court documents the city utility has a “right” to provide power to all of the development, because the Gateway Commons property is inside city limits. The city annexed the acreage last month, but Kenergy argues it has a historical and legal right to provide power to the new development.
